Terms of use

These terms apply when you use esignco.ca and when you ask eSign Co. ("we", "us") for a quote or buy a sign from us. By using our website or placing an order, you agree to them. Your quote or order confirmation may include extra terms for your project. If they differ from these terms, the quote or order confirmation applies.

About us

eSign Co. is a Canadian-owned sign company with an office in Calgary, Alberta. We manufacture signs at our own production company in Shenzhen, China, and ship them to customers across Canada.

Using our website

The information on our website is general. Photos, sizes and prices shown are examples, and we may change the website at any time. You agree not to misuse the site, including by trying to break into it, upload harmful files, send spam through our forms, or copy its content in bulk. The text, photos, logos and other content on the site belong to us or are used with permission, and you may not reuse them without our written consent.

Quotes

• Quotes are free and carry no obligation.
• A quote is based on the details you give us. If the size, materials, lighting, quantity or delivery address change, the price may change.
• Prices are in Canadian dollars and include delivery, duties and brokerage to your address in Canada unless the quote says otherwise. GST, HST, PST or QST are added where they apply.
• A quote is valid for the period stated on it, or 30 days if no period is stated.

Match my quote

To be compared, the other quote must be dated within the last 60 days and be for the same specification: size, materials, lighting and delivery. We will price the same sign and show you the difference in writing. If we cannot match or beat it, we will tell you. Whether a quote qualifies is our decision, and you are never obliged to order.

Orders and design approval

Your order is confirmed when you accept our quote in writing and we send you an order confirmation. Production starts only after you confirm your order, approve the final design and make any payment the confirmation requires.

Please check the final design carefully, including spelling, sizes, colours, lighting and mounting. We build exactly to the design you approve, so mistakes in an approved design are your responsibility. Changes you ask for after production has started may cost extra and delay your order.

Payment

You agree to pay the amounts and follow the payment schedule set out in your order confirmation. We may hold production or shipping until a payment that is due has been made.

Cancellations

Every sign is made to order. You can cancel before production starts, and we will refund what you have paid, less the cost of any design or engineering work already done. Once production has started, we may keep the amount needed to cover materials and work completed, up to the full price of the order.

Your artwork and logos

You confirm that you own, or have permission to use, the logos, trademarks, images and designs you send us, and that making your sign will not infringe anyone's rights. You agree to cover any claims, costs or losses we face if that is not the case. We may refuse designs that we believe are unlawful or infringe someone else's rights. You keep ownership of your logo and artwork.

We may photograph your finished or installed sign and show it on our website and social media. If you would rather we didn't, just tell us.

Timelines and delivery

Production and shipping times are estimates, not guarantees. They depend on the size of the sign, the shipping method, customs and carriers. We are not responsible for delays caused by events outside our control, such as customs inspections, carrier delays, severe weather, or other disruptions.

• We ship crated and tracked to the address you give us. Make sure it is correct. Extra costs caused by a wrong address or a missed delivery may be charged to you.
• Larger crates may need a forklift or several people to unload, and someone must be on site to sign for them. We will tell you in advance.
• Responsibility for the sign passes to you when it is delivered or picked up.

Damage in transit

Inspect the crate before you sign for the delivery. If you see damage, take photos, note it on the delivery receipt, and contact us within 48 hours. We will arrange a repair or replacement for damage that happened in transit.

Installation, permits and electrical work

Unless your order confirmation says we will install, installation is not included. Every sign comes with mounting templates for your installer. You are responsible for:

• getting any sign permits and landlord or property approvals;
• following local bylaws and building codes;
• making sure the wall or structure can support the sign; and
• having a qualified installer mount the sign and a licensed electrician connect illuminated signs.

Our illuminated signs carry cUL marks for use in Canada.

Warranty

We warrant our signs against defects in materials and workmanship for the periods stated in your order confirmation and on our Quality page. If a covered part fails, we will repair or replace it, or refund that part of the price, at our choice. To make a claim, call or email us with a photo of the problem.

The warranty does not cover damage from improper installation or wiring, changes or repairs made by others, accidents, vandalism, power surges, severe weather or other events outside our control, or normal wear. Unless we agree otherwise in writing, it does not cover the cost of removing or reinstalling the sign.

Trade accounts

Trade accounts are for sign shops and installers, and we may approve, decline or close an account at our discretion. When you send us production-ready drawings, we build exactly what is on them, and you are responsible for their accuracy. If you ask us to ship directly to your client without eSign Co. branding, you remain our customer and are responsible for your client's order, installation and support. Extra terms may apply to trade accounts.

Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost business or business interruption. Our total liability for any claim about an order is limited to the amount you paid for that order. Nothing in these terms limits any rights you have under consumer protection laws that cannot be waived.

Privacy

Our Privacy policy explains how we collect, use and protect your personal information.

Governing law

These terms are governed by the laws of Alberta and the federal laws of Canada that apply there. Any dispute will be handled by the courts of Alberta, unless the consumer protection laws of your province give you the right to bring it where you live.

Changes to these terms

We may update these terms from time to time. The date at the top shows when they last changed. Changes apply to orders placed after that date.
